2017 TERMS & CONDITIONS FOR ADVERTISEMENTS AND PAID-FOR EDITORIAL
‘GM Business Connect’ shall be defined as the trading name of Business Connect Publishing Limited, a company registered in England and Wales with company number 08691083.
‘The Publications’ shall be defined as the GM Business Connect Magazines which are published and distributed 6 times per year. These are in the form of printed magazines, hosted pdf editions, plus any online version of the magazine.
‘The Client’ shall be defined as the person or company with whom goods and/or services are to be supplied.
‘Goods and/or services’ shall be known to be any item which GM Business Connect Magazine supplies to any of its Clients for which it is agreed that charges may or may not be applicable. Without limitation, advertising space, graphic and creative design services are included in this definition.
COPY DEADLINE AND FORMATS
The copy deadline for all advertisements and editorial features is as stated on the booking form supplied. It cannot be guaranteed that copy received after this date will be included in The Publications, although every effort will be made to accommodate late requests.
All advertisements created by GM Business Connect Magazine will be proofed to The Client prior to publication. It is The Client’s responsibility to ensure that any copy proofed and approved is accurate, legal and copyright free. The Business takes no responsibility for loss or damage resulting in an advert being incorrect, having been proofed and approved by The Client.
Copy can be supplied in any of the accepted formats as detailed on the booking form. Ensure supplied copy for advertisements is the correct size and resolution, as specified on the booking form.
GM Business Connect Magazine reserves the right to refuse advertisements which may be defamatory or offensive, or which promote products that many be considered indecent or illegal.
GM Business Connect Magazine makes no guarantee that advertising will be successful. For the best chance of success, GM Business Connect Magazine recommends that advertising is booked for three or more issues; it is a proven theory that repetition brings familiarity.
COPYRIGHT AND FEES OF ADVERTISEMENTS AND PAID-FOR EDITORIAL
The copyright of advertisements designed by GM Business Connect Magazine on The Client’s behalf is owned solely by GM Business Connect Magazine.
GM Business Connect Magazine may provide copies/proofs of the advertisement for approval by The Client prior to publication, but this does not infer in any way ownership or permission of this copy/proof for use by The Client, and as such must not be stored, either digitally or physically, by The Client once approval has been given, nor reproduced or redistributed to third parties without permission of GM Business Connect Magazine.
If The Client wishes to use advertisements designed by GM Business Connect Magazine in other publications, The Client will be required to ask permission of GM Business Connect Magazine, which should be given in writing, and a release fee may be charged.
The advertisement design fee for Clients where the advert is to only feature in GM Business Connect Magazine will be zero. The design will feature text, images and logos supplied by The Client, and once a first draft of the advertisement has been presented to The Client, then only one set of minor amends are included in the zero fee. More detailed design options and alternatives are available at a cost that would be agreed by both GM Business Connect Magazine and The Client in advance of that work.
Whilst Clients are able to change their advertisement on a per issue basis, for Clients which have used the advert design service and whom wish to change their advert an amendment fee may be charged if the changes are deemed significant at a cost that would be agreed by both GM Business Connect Magazine and The Client in advance of that work.
Paid-for editorial features are subject to editorial control by GM Business Connect Magazine, both in content (text and images) plus design layout (which will follow a strict template relating to editorial features in GM Business Connect Magazine. Any text supplied by The Client must be in a text only format, photos and any other images must also be subject to a minimum size, format and resolution, detailed on the booking form.
INVOICING AND PAYMENT
All invoices raised by GM Business Connect Magazine shall become due for payment by the date shown on the invoice, unless consent is expressly given in writing to The Client for an extension of this period, or terms of any account facility between GM Business Connect Magazine and The Client expressly states. Invoices which are overdue for a period in excess of fourteen days from the invoice due date for any services will be subject to credit control procedures which may or may not include the filing of a County Court Order.
The signing of the Booking form shall amount to acceptance of these conditions.
Advertising space must be cancelled either in writing or by electronic communication (email), with receipt of acknowledgement by GM Business Connect Magazine, by the copy deadline of the issue preceding publication.
If advertising space has been booked for a run of three or more issues at the outset, and a discounted rate has been applied, and The Client subsequently cancels part way through any booking period (in accordance with the time scales mentioned above), GM Business Connect Magazine reserves the right to apply for a single issue booking rate for all advertisements booked in that run. This increased rate will apply and further invoices will be issued to collect the additional premiums relating to that single issue booking rate.
Cancellation of the advertisement or insertion will incur the following fees:
a) Up to 4 weeks before deadline: 30% of the invoice
b) Less than 4 weeks but more than 2 weeks before deadline: 50% of the invoice
c) Less than 2 weeks before deadline: 100% of the invoice
CLIENTS AND THEIR CUSTOMERS
GM Business Connect Magazine takes no part in the contract between The Client and their customers. Readers of the magazine are reminded that GM Business Connect Magazine accepts no liability for loss, damage or difficulties resulting from contracts between The Client and their customers, nor from errors, omissions or claims made by Clients.
Inclusion within The Publications does not imply a recommendation.
Any issue resolution remains between The Client and their customer, and GM Business Connect Magazine will accept no responsibility in establishing this resolution process.
GM Business Connect Magazine reserves the right to remove any advertisements for Clients who are deemed to bring The Publications into disrepute or which have been requested to be removed by the relevant legal or regulatory authorities without notice and without recourse. Refunds will not be made, and full payment may still be levied on the Client for the period booked. GM Business Connect Magazine’s decision is final.
These Terms and Conditions are formed under the laws of England and Wales and any legal claim shall be made in a court via the legal system of England and Wales.
The written and visual content apart from supplied advertisements The Publications and GM Business Connect website are protected by copyright and are owned entirely by Business Connect Publishing Limited.
You may not reproduce or redistribute any articles, adverts, content or design, either online or in print or digital media, either whole of part thereof, without first obtaining written permission from the Editor. Failure to obtain written permission from the Editor will result in legal action where full costs will be covered by any person(s) or business found using copyright material.
In addition, a full apology must be published in the publication or website accused of utilising material owned by The Business. The apology text must be approved in full by the Editor of GM Business Connect Magazine. Failure to comply will result in further legal action where full costs will be covered by any person(s) or business found using copyright material.
The unique combination of fonts, images, colours, sizes, typography, and positioning (“the design”) of GM Business Connect Magazines, their website and GM Business Connect Magazine marketing and/or advertising material is copyright and may not be reproduced.
The business testimonials in The Publications have not been verified by GM Business Connect Magazine. Any person who is in doubt should ask the business to produce their own testimonials.
CHANGES TO TERMS AND CONDITIONS
GM Business Connect Magazine, at all times, reserves the right to change the Terms and Conditions set out herein this document without prior written notice to any of its Clients and any subsequent changes will become applicable immediately. No claims will be entered into which may not have been applicable in previous revisions of this document which are subsequently made provision for. Any claims by any Client will only be acceptable on grounds outside the current revision of this document. The Business will, at all times, where reasonably possible, make available for viewing its Terms and Conditions through its website.
